It can be difficult for law enforcement and prosecutors to prove that a driver is impaired by cannabis.
Some states use a per se THC blood content threshold. But a 2016 study by the AAA Foundation for Traffic Safety concluded that a “quantitative threshold for per se laws for THC following cannabis use cannot be scientifically supported.”
